General Membership Meeting MinutesOctober 10, 2006

A quorum was present.
President Carbone called to order the General Membership Meeting of October 10, 2006 at 6pm in the 5th floor cafeteria at Gertz Plaza.
A motion to accept the September 12, 2006 General Membership minutes was made by Dennis Ifill and seconded by Darryl Adams. The motion was unanimously approved.
A motion to accept the Treasurer's Report of October, 2006 was made by Dennis Ifill and seconded by Charmaine Hardaway. The motion was unanimously approved.
Any members entitled to an increment payment for the October cycle will be receiving it in the November 1, 2006 paycheck.
Copies of the 2007 meeting schedule were made available to the General Membership.
On September 26, 2006 President Carbone signed the contract agreement with Smartweb, to create and manage a Local 1359 Web Site.
LABOR DAY PARADE: the parade took place on Saturday, September 9, 2006. The event was attended by John Lafferty who displayed the Local's banner while marching in the parade.
ANNUAL HOLIDAY PARTY: The Local's Annual Holiday Party will be held on Saturday, December 16, 2006 from 9 PM to 2 AM at Bruno's on the Blvd., 88-25 Astoria Blvd., East Elmhurst, NY. Tickets are $20.00 for Local 1359 members and their 1st guest. All other quests will pay $30.00 per ticket. Tickets are currently on sale.
Vice President Ifill made a motion to allocate up to $15,000.00 to cover expenses for the Holiday Party, with the understanding that any money not used will be returned to the Local's Treasury. The motion was seconded by Charmaine Hardaway. The motion was unanimously approved.
President Carbone advised the Executive Board that he spoke to the NYS Dept. of Civil Service concerning the reallocation of grades for the Rent Inspectors. Civil Service advised President Carbone that a decision should be made by October31, 2006. Civil Service has also scheduled a Rent Inspector I exam for January 20, 2007. The announcement will be issued November 3, 2006. The deadline to apply will be December 28, 2006.
President Carbone brought to the attention of the General Membership a report in the N.Y. Times dated September 19, 2006 which states that all State agencies located at 25 Beaver St. (where many of our members are located) may be moved to the Freedom Tower in 2011 or 2012.
There will be a Worker's Compensation Seminar concerning DC 37 members who may have been medically affected by working at Ground Zero on Saturday, October 14, 2006 from 9:00 am - 1:00 pm., at DC-37, Room 1. A new law has extended the filing deadline for filing a Workers compensation claim until August 14, 2007. To register, members can call 212-815-1685.
LEGISLATIVE CONFERENCE: the Annual DC 37 Legislative Conference, which sets the union's legislative goals for 2007, will take place at DC-37 on October 28, 2006. Coupons to attend are available through President Carbone or the PEP. The deadline is October 23, 2006.
FLEX SPENDING ACCOUNT 2007: the enrollment period began September 25, 2006 and ends November 10, 2006. There are two accounts:
1) HEALTH CARE ACCOUNT: minimum contribution of $100.00 and a maximum contribution of $4000.00.
2) DEPENDENT CARE ADVANTAGE ACCOUNT: no contribution is required to join to receive the employer contribution. The amount of such contribution depends on a member's salary.
AFSCME FAMILY SCHOLARSHIP PROGRAM: 13 scholarships are still available to graduating high school seniors. Deadline to apply: 12/31/06.
EMPIRE HEALTH PLAN: the projected increase for 2007 for family and individual rates are 8 to 9%.
PER CAPITA TAX INCREASE: at the 2006 Chicago Convention in August the body approved significant per capita tax increases which will begin to go into effect as of January, 2007. On top of the normal monthly rate increase of approximately $.90 to $1.00 there will be an additional $1.25 per month increase in January, 2007. On January 1, 2008 there will be an additional $.75 increase and on January 1, 2009 an additional $.50 increase will be added.
HUD SECTION 8 PROGRAM: DHCR has previously ruled that Section 8 vouchers are not subject to the "same terms and conditions" requirement of the Rent Stabilization Code. Therefore an owner was not obligated to renew such a voucher when he renews a section 8 tenant's lease. However, there was a decision, in the 1st Appellate Division, Rosario vs. Diagonal Realty, which was issued on September 19, 2006, which ruled that such vouchers are considered to be part of the same terms and conditions of the lease and therefore must be renewed. Absent this decision, many Section 8 tenants could have been evicted from their homes because they could not have otherwise afforded to pay the monthly rent.
CHAPTER 111 OF THE LAWS OF 2006: was enacted into law on June 30, 2006. This is a corrected pay bill for Local 1359 members. The law is retroactive to April 1, 2004. There are approximately 90 members affected by this legislation who should receive back-pay awards (of approximately $32 per pay period) as their longevity award dates will be backdated to the first pay period immediately after they had served 5 to 10 years at the job rate of their title. Payment is expected in the November 15, 2006 pay checks.
President Carbone advised Professional Rep. Laurence Ramer that the next six (6) credit CLE course for attorneys will be held at New York Law School on November 10th or 13th 2006
On September 13, 2006, every Local 1359 member was mailed the Report of the Local's Constitution Committee which proposed amending various provisions of the Local's Constitution (see attached). The notice further specified that the first reading of the proposed changes would occur at the October 10, 2006 General Membership Meeting and that a second reading and vote would be held at the November 14, 2006 General Membership Meeting. The first reading of each of those constitutional changes occurred at the October 10, 2006 meeting by President Carbone. A second reading and a vote will be taken at the November 14, 2006 General Membership Meeting. A discussion was held and all questions were answered.
A motion to adjourn was made by Dennis Ifill and seconded by Jackie Hairston. The motion passed unanimously.
